Welcome to TakeALittle

These Terms of Service ("Terms", "ToS") govern your use of TakeALittle ("we", "us", "our", "the service", "the platform"), a price comparison and tracking service operating at www.takealittle.com. By accessing or using our platform, you agree to be bound by these Terms.

Operating Entity: TakeALittle currently operates as a sole proprietorship and may transition to a registered company (Pty) Ltd in the future. Users will be notified of any material changes to the operating entity through our platform and via email.

  • 1. Acceptance of Terms

    By creating an account, accessing, browsing, or using TakeALittle in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and all policies referenced herein, including our Privacy Policy and Disclaimer.

    1.2 Age Requirement

    You must be at least 18 years old to use our service. By using TakeALittle, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into binding contracts in South Africa.

    1.3 Changes to Terms

    We reserve the right to modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to our platform. Your continued use of TakeALittle after any changes constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.

    Each time you access or use our service, you agree to be bound by the then-current version of these Terms.


    2. Service Description

    2.1 Nature of Service

    TakeALittle is an independent price comparison and tracking service that aggregates publicly available pricing information from various online retailers to help consumers make informed purchasing decisions.

    2.2 No Affiliation

    IMPORTANT: TakeALittle is not affiliated with, endorsed by, sponsored by, or in any way connected to Takealot Online (RF) (Pty) Ltd or any other retailer whose products appear on our platform. We are an independent service that displays publicly available information for comparison purposes.

    2.3 Information Source

    All product information, pricing, availability, and related data displayed on our platform is sourced from publicly accessible information on third-party retailer websites. We do not create, verify, or control this information.

    2.4 Service Functionality

    Our platform provides:

  • Price comparison across retailers
  • Historical price tracking
  • Price drop notifications (for registered users)
  • Product availability monitoring
  • Deal analysis and recommendations
  • 2.5 No Selling or Fulfillment

    We do not sell products, process transactions, or fulfill orders. When you click through to a retailer's website, any transaction you complete is solely between you and that retailer, subject to their terms and conditions.


    3. Account Registration and Security

    3.1 Account Types

    TakeALittle offers three service tiers:

  • Unregistered Users: Basic browsing with advertising
  • Free Registered Users: Price tracking and notifications with advertising
  • Premium Users: Enhanced features without advertising (subscription required)
  • 3.2 Account Creation

    To access registered user features, you must create an account by providing:

  • A valid email address
  • A secure password
  • You warrant that all information you provide during registration is accurate, current, and complete.

    3.3 Account Security

    You are solely responsible for:

  • Maintaining the confidentiality of your password and account credentials
  • All activities that occur under your account
  • Immediately notifying us of any unauthorized access or security breach
  • We recommend:

  • Using a unique, strong password (minimum 8 characters with uppercase, numbers, and symbols)
  • Never sharing your login credentials with anyone
  • Enabling two-step verification when available
  • 3.4 Account Liability

    You accept all risks of unauthorized access to your account. We are not liable for any loss or damage arising from your failure to maintain account security or from unauthorized use of your account.

    3.5 Account Termination

    We reserve the right to suspend, disable, or terminate your account at any time for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent or abusive behavior
  • Extended period of inactivity
  • Technical or security concerns
  • You may terminate your account at any time through your account settings or by contacting us.


    4. Service Tiers and Advertising

    4.1 Free Service Tier

    Unregistered and free registered users may be shown advertisements. By using the free service, you consent to the display of advertising content.

    4.2 Advertising Disclosure

    Advertisements displayed on our platform are provided by third-party advertising networks. We do not endorse or guarantee the accuracy of any advertised products or services. Your interactions with advertisements and advertisers are solely between you and the advertiser.

    4.3 Premium Service

    Premium subscribers receive an ad-free experience and enhanced features as described on our pricing page. Premium subscriptions are subject to the payment terms in Section 8 below.

    5.1 No Guarantee of Accuracy

    CRITICAL DISCLAIMER: While we strive to provide accurate and up-to-date pricing information, we make NO WARRANTY, REPRESENTATION, OR GUARANTEE regarding the accuracy, completeness, timeliness, or reliability of any pricing, availability, or product information displayed on our platform.

    5.2 Third-Party Data

    All pricing and product information is sourced from third-party retailers. Prices, availability, and product details can change at any time without notice. We are not responsible for any discrepancies between information displayed on TakeALittle and actual prices or availability on retailer websites.

    5.3 Informational Purpose Only

    Our platform is provided for informational purposes only. You should always verify current prices, availability, and product details directly on the retailer's website before making any purchase decision.

    5.4 No Price Guarantee

    We do not guarantee that prices displayed on our platform are the lowest available prices, nor do we guarantee that the products are in stock or available for purchase.

    5.5 User Responsibility

    You are solely responsible for verifying all information before making any purchasing decisions. We strongly recommend checking directly with the retailer before completing any transaction.


    6. Intellectual Property Rights

    6.1 TakeALittle Intellectual Property

    All content, features, functionality, and intellectual property on TakeALittle (excluding third-party content) are owned by TakeALittle, its licensors, or other content providers. This includes but is not limited to:

  • Website design and layout
  • Software code and algorithms
  • Logos, trademarks, and branding
  • Original written content and analysis
  • Data compilation and presentation
  • 6.2 Limited License to Users

    We grant you a limited, non-exclusive, non-transferable, revocable license to access and use TakeALittle for personal, non-commercial purposes in accordance with these Terms.

    6.3 Third-Party Intellectual Property

    Product names, descriptions, images, trademarks, and other content displayed on our platform belong to their respective owners (retailers, manufacturers, brands). We display this information under principles of fair use and nominative use for comparative purposes only.

    We do not claim ownership of any third-party trademarks, product names, or retailer brands. All trademarks are the property of their respective owners.

    6.4 User-Generated Content

    If you submit any content to TakeALittle (such as reviews, comments, or feedback), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for the purpose of operating and promoting our service.

    6.5 Copyright Infringement

    If you believe any content on our platform infringes your intellectual property rights, please refer to our DMCA Policy for the procedure to submit a takedown notice.


    7. Prohibited Uses and User Conduct

    7.1 Acceptable Use

    You agree to use TakeALittle only for lawful purposes and in accordance with these Terms and our Acceptable Use Policy.

    7.2 Prohibited Activities

    You agree NOT to:

    a) Automated Access:

  • Use any robot, spider, scraper, crawler, or other automated means to access our platform
  • Use any device, software, or routine to interfere with the proper operation of our platform
  • Attempt to gain unauthorized access to our systems, servers, or networks
  • b) Abuse and Interference:

  • Transmit viruses, malware, or any other malicious code
  • Attempt to bypass security measures or access restrictions
  • Engage in any activity that disrupts or interferes with our service
  • Overload or attempt to overload our infrastructure
  • c) Unlawful Activity:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights of others
  • Engage in fraudulent or deceptive practices
  • Harass, abuse, or harm other users
  • d) Commercial Exploitation:

  • Resell, redistribute, or commercially exploit access to our service
  • Use our platform for any commercial purpose without our written permission
  • Create derivative works based on our platform
  • Frame or mirror any portion of our platform
  • e) Data Collection:

  • Collect or harvest any personal data from our platform or users
  • Compile or use pricing data for commercial purposes
  • Republish or redistribute our content without permission
  • 7.3 Consequences of Violations

    Violation of any provision in this section may result in:

  • Immediate termination of your account
  • Legal action to recover damages
  • Cooperation with law enforcement authorities
  • Permanent ban from accessing our service

  • 8. Payment Terms (Premium Subscriptions)

    8.1 Subscription Fees

    Premium subscription fees are displayed on our pricing page. All fees are in South African Rand (ZAR) unless otherwise stated.

    8.2 Payment Processing

    Payments are processed through PayFast, a third-party payment service provider. By subscribing to a premium plan, you agree to PayFast's terms and conditions. We do not store or process your payment card information directly.

    8.3 Billing Cycle

    Subscriptions are billed on a recurring basis (monthly or annually) depending on the plan you select. You authorize us to charge your payment method at the start of each billing cycle.

    8.4 Automatic Renewal

    Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You are responsible for canceling your subscription through your account settings.

    8.5 Cancellation

    You may cancel your premium subscription at any time through your account settings. Upon cancellation:

  • You will retain premium access until the end of your current billing period
  • No refunds will be provided for partial billing periods
  • Your account will revert to the free tier after the current period expires
  • 8.6 Price Changes

    We reserve the right to change subscription prices at any time. Price changes will apply to new subscriptions and renewals after 30 days' notice to existing subscribers.

    8.7 Refund Policy

    No refunds are provided for premium subscriptions, except where required by applicable consumer protection law. If you are dissatisfied with the service, you may cancel at any time to prevent future charges.

    8.8 Payment Disputes

    Any disputes regarding payments should be directed to our support team and PayFast. We will work to resolve payment issues in good faith.


    9. Service Availability and Modifications

    9.1 Service Availability

    We strive to maintain continuous availability of our platform, but we do not guarantee uninterrupted access. Our service is provided on an "as-is" and "as-available" basis.

    9.2 Maintenance and Downtime

    We may perform maintenance, updates, or modifications that temporarily disrupt service availability. We will attempt to schedule maintenance during off-peak hours when possible.

    9.3 Right to Modify or Discontinue

    We reserve the right at any time to:

  • Modify, suspend, or discontinue any aspect of our service
  • Change features, functionality, or content
  • Impose limits on certain features or restrict access to parts of the service
  • Remove or modify pricing data, product listings, or other content
  • We will provide reasonable notice of material changes when practicable, but are not obligated to do so.

    9.4 No Liability for Service Changes

    We are not liable to you or any third party for any modification, suspension, or discontinuance of our service.

    Our platform contains links to third-party websites (including retailer websites where products can be purchased). These links are provided for your convenience only.

    10.2 No Endorsement

    We do not endorse, control, or assume responsibility for any third-party websites, content, products, or services. Your use of third-party websites is at your own risk and subject to their terms and conditions.

    10.3 Third-Party Transactions

    Any transactions you enter into with third-party retailers are solely between you and that retailer. We are not a party to such transactions and have no liability arising from them.

    10.4 Third-Party Service Providers

    We use third-party service providers (such as PayFast for payments and potential advertising networks) to operate our platform. These providers have their own privacy policies and terms of service, which we encourage you to review.


    11. Limitation of Liability

    11.1 Types of Damages Excluded

    TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW, TakeALittle, its owners, officers, employees, agents, and affiliates shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Personal injury or property damage (except as caused by our gross negligence or willful misconduct)
  • Damages arising from your use or inability to use the service
  • Damages resulting from unauthorized access to your account
  • Damages arising from errors, inaccuracies, or omissions in pricing or product information
  • Damages resulting from transactions with third-party retailers
  • Damages from interruptions, delays, or service unavailability
  • 11.2 Maximum Liability Cap

    Our total cumulative liability to you for any and all claims arising out of or relating to these Terms or your use of our service shall not exceed the greater of:

  • ZAR 500 (five hundred South African Rand), or
  • The amount you paid to us for premium services in the 12 months preceding the claim
  • 11.3 Consumer Protection Act Exception

    Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our gross negligence or willful misconduct
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded or limited under South African law, including the Consumer Protection Act, 2008
  • 11.4 Basis of the Bargain

    You acknowledge that the limitations of liability in this section are fundamental elements of the agreement between you and TakeALittle, and that we would not provide the service without these limitations.


    12. Indemnification

    12.1 Your Indemnification Obligation

    You agree to indemnify, defend, and hold harmless TakeALittle, its owners, officers, employees, agents, affiliates, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms or any applicable law
  • Your violation of any rights of another party
  • Your use or misuse of the service
  • Your submission of any user-generated content
  • Your transactions or disputes with third-party retailers
  • Any claim that your use of the service caused harm to a third party
  • Your breach of any representation or warranty in these Terms
  • 12.2 Defense and Settlement

    We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.


    13. Disclaimers and Warranties

    13.1 "AS-IS" and "AS-AVAILABLE" Service

    OUR PLATFORM IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

    13.2 Disclaimer of Warranties

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties regarding the accuracy, reliability, or completeness of pricing or product information
  • Warranties that the service will be uninterrupted, secure, or error-free
  • Warranties that defects will be corrected
  • Warranties regarding the results obtained from using the service
  • 13.3 No Advice or Information

    No advice or information, whether oral or written, obtained by you from TakeALittle or through the service shall create any warranty not expressly stated in these Terms.

    13.4 Third-Party Content

    We make no warranties or representations about the accuracy, reliability, completeness, or timeliness of any third-party content, including product information, pricing, or availability displayed on our platform.

    13.5 South African Law

    Where applicable law (including the Consumer Protection Act, 2008) implies warranties or conditions that cannot be excluded, those warranties or conditions are included, but our liability for breach is limited to the extent permitted by law.


    14. Dispute Resolution

    14.1 Governing Law

    These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles.

    14.2 Jurisdiction

    You and TakeALittle agree that the High Court of South Africa (Gauteng Division, Pretoria) shall have exclusive jurisdiction to hear and determine any legal proceedings arising out of or in connection with these Terms, regardless of whether the disputed amount would ordinarily fall within the jurisdiction of a lower court.

    14.3 Informal Resolution

    Before initiating any formal legal proceedings, we encourage you to contact us to attempt to resolve any disputes informally. Many disputes can be resolved quickly and amicably through direct communication.

    14.4 Consumer Protection

    Nothing in this section affects your rights under the Consumer Protection Act, 2008, including your right to approach the Consumer Goods and Services Ombud (CGSO) with complaints.

  • Posting on our platform
  • In-app notifications
  • Physical mail (if necessary)
  • You agree that all electronic communications satisfy any legal requirement that communications be in writing.

    15.2 Email Delivery

    Notices sent by email will be deemed received on the date sent, provided that we have a valid email address on file for you. You are responsible for keeping your email address up to date in your account settings.

    16. General Provisions

    16.1 Entire Agreement

    These Terms, together with our Privacy Policy, Disclaimer, Acceptable Use Policy, Cookie Policy, and any other policies referenced herein, constitute the entire agreement between you and TakeALittle regarding your use of the service.

    16.2 Precedence

    If there is any conflict between these Terms and any other policy document, these Terms shall take precedence unless explicitly stated otherwise.

    16.3 Severability

    If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

    16.4 No Waiver

    Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision shall be effective only if in writing and signed by an authorized representative of TakeALittle.

    16.5 Assignment

    You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. We may freely assign or transfer these Terms or our rights and obligations without restriction.

    16.6 Survival

    Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: intellectual property rights, disclaimers, limitations of liability, indemnification, and dispute resolution provisions.

    16.7 Headings

    Section headings are for convenience only and shall not affect the interpretation of these Terms.

    16.8 Force Majeure

    We shall not be liable for any failure to perform our obligations under these Terms where such failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.


    17. Consumer Protection Rights

    17.1 Consumer Protection Act Compliance

    TakeALittle is committed to compliance with the Consumer Protection Act, 2008 (CPA). Nothing in these Terms is intended to limit your rights under the CPA.

    17.2 Fair Dealing

    We are committed to fair and honest dealing with all users. If you believe we have engaged in unfair, unreasonable, or unjust conduct, you may lodge a complaint as outlined in Section 18 below.

    17.3 Right to Information

    You have the right to receive information in plain and understandable language. If any provision of these Terms is unclear, please contact us for clarification.

    17.4 Cooling-Off Period

    For premium subscriptions, you may have a cooling-off period as provided under the CPA. Contact us within the applicable period if you wish to cancel a new subscription.

    If you have a complaint about our service, please contact us first through our platform support system or via email. We will make every effort to resolve your complaint promptly and fairly.

    18.2 Complaint Process

    When submitting a complaint, please provide:

  • Your desired resolution
  • We will acknowledge receipt of your complaint within 3 business days and provide a substantive response within 15 business days.
