    Our Response to Valid Claims

    Upon receiving a valid copyright claim, we will:

  • Acknowledge receipt within 3-5 business days
  • Investigate the claim
  • Remove or disable access to the allegedly infringing content if appropriate
  • Notify the user who posted the content (if applicable)
  • Provide information about the counter-notification process
  • Timeline: We aim to respond to valid claims within 10 business days.


    Trademark Infringement Claims

    Nominative Fair Use

    Important: TakeALittle uses third-party trademarks for the purpose of price comparison and consumer information. This is generally considered nominative fair use or fair dealing under South African law.

    We use trademarks to:

  • Identify products accurately
  • Compare prices across retailers
  • Provide consumer information
  • Facilitate informed purchasing decisions

  • Remove content only if legally required or if we determine our use is improper
  • Note: Many trademark claims against price comparison websites are not valid due to nominative fair use. We will vigorously defend our right to use trademarks for comparison purposes.


    Counter-Notification Process

    If Your Content Was Removed

    If your content was removed due to a copyright claim and you believe the removal was improper, you may submit a counter-notification.

    When to Submit a Counter-Notification

    You may submit a counter-notification if:

  • You have a good faith belief that the content was removed due to mistake or misidentification
  • The content was non-infringing or you have authorization to use it
  • You are willing to accept jurisdiction of South African courts

    Upon receiving a valid counter-notification:

  • We will forward it to the original complainant
  • We will inform them that we may restore the content in 10-14 business days
  • If the complainant does not file a court action, we may restore the content
  • If the complainant files a court action, we will await the court's decision

  • Repeat Infringer Policy

    Three-Strike Policy

    Users who repeatedly infringe intellectual property rights will face escalating consequences:

    First Infringement:

  • Warning via email
  • Content removal
  • Educational information about intellectual property
  • Second Infringement:

  • Temporary account suspension (30 days)
  • Content removal
  • Final warning
  • Third Infringement:

  • Permanent account termination
  • Ban from creating new accounts
  • Possible legal action
  • Serious Infringements

    For particularly serious or willful infringements, we may:

  • Terminate accounts immediately (without prior warnings)
  • Report to law enforcement authorities
  • Cooperate with legal proceedings

    Our Good Faith Efforts

    We make good faith efforts to:

  • Use the lowest resolution necessary for identification

  • False Claims

    Penalties for False Claims

    Under South African law and our Terms of Service, submitting false copyright or trademark claims may result in:

  • Liability for damages
  • Attorney's fees and costs
  • Account termination
  • Legal action for perjury or fraud
  • Knowingly False Claims

    If you knowingly submit a false claim:

  • You may be liable for all damages incurred

    Our Rights and Limitations
